Terms of Service

Welcome to MedAi! Please read these Terms of Service ("Terms") carefully before using the MedAi mobile application ("App" or "MedAi").

By installing, accessing, or using MedAi, you agree to be bound by these Terms. If you do not agree to these Terms, do not install, access, or use the App.

1. NOT MEDICAL ADVICE (CRITICAL DISCLAIMER)

MEDAI IS AN INFORMATIONAL, REMINDER, AND SCHEDULING ASSISTANT ONLY.

  • No Professional Relationship: The App, including its AI Pill-Scan, AI-guided medication advice, chat features, and notifications, does not constitute, offer, or replace professional medical advice, diagnosis, treatment, or clinical judgment.
  • AI Disclaimer: The AI Pill-Scan and Chat features use Google Generative AI (Gemini) to analyze images and text inputs. Artificial intelligence is subject to errors, hallucinations, and misidentifications. NEVER rely on the AI Pill-Scan to identify a pill, verify a dosage, or determine if a medication is safe to take. Always verify medication details (including name, dosage, and warnings) with a licensed healthcare professional, pharmacist, or the official prescribing information package insert.
  • Emergency Situations: MedAi should never be used in a medical emergency. In the event of a medical emergency, immediately contact your local emergency services (such as 911) or go to the nearest emergency room.

YOUR USE OF THE APP AND RELIANCE ON ANY CONTENT OR AI-GENERATED ADVICE IS SOLELY AT YOUR OWN RISK.

2. ALARM AND NOTIFICATION RELIABILITY

MedAi includes features designed to schedule local notifications and native alarms (using iOS AlarmKit and Android system alarms) to remind you to take your medication.

  • No Guarantee of Alarms: We cannot and do not guarantee that alarms or notifications will trigger deterministically or on time. Alarm delivery depends heavily on factors outside our control, including device settings, operating system updates, hardware conditions, battery charge, "Do Not Disturb" or Focus modes, and operating system battery optimization policies (e.g., Android battery saver or background restriction systems).
  • User Responsibility: You are responsible for ensuring that MedAi has all necessary permissions (Notifications, Alarms, and Battery Optimization bypasses) and that your device is configured to allow alarms to ring. You must not rely on MedAi as your sole method for taking critical, life-sustaining medications.

3. ACCOUNTS AND ELIGIBILITY

  • Age Requirement: You must be at least 13 years of age (or the minimum legal age in your jurisdiction) to use the App. If you are under 18, you must have permission from a parent or legal guardian.
  • Anonymous Accounts: To simplify onboarding, MedAi automatically creates an anonymous account for you using Google Firebase Authentication. This account is tied to your specific device. If you delete the App, clear your device's storage, or lose access to your device, you may lose access to your premium subscription entitlements and scan history.

4. SUBSCRIPTIONS AND IN-APP PURCHASES

MedAi offers free access as well as premium subscription options managed through RevenueCat and processed via the Apple App Store or Google Play Store.

  • Free Tier Limits: The free tier of MedAi is subject to a usage limit (e.g., a maximum of 3 active medicines). Medicines added beyond this limit will be locked (deactivated, excluded from alarms, and greyed out) unless you upgrade to a Premium subscription.
  • Subscriptions: Subscription fees, billing cycles, renewals, and payment terms are governed by the respective App Store (Apple App Store or Google Play Store) terms and handled through RevenueCat.
  • Cancellations and Refunds: You can cancel your subscription at any time through your Apple or Google account settings. All refunds are processed and governed by the refund policies of Apple or Google, and we do not have the ability to issue refunds directly.

5. OVER-THE-AIR (OTA) UPDATES

We use Shorebird Code Push to issue over-the-air updates, bug fixes, and performance improvements directly to the App. By using the App, you consent to these silent, automatic updates.

6. PROHIBITED USES

You agree not to use the App to:

  • Reverse engineer, decompile, or disassemble the App's source code or backend systems.
  • Attempt to bypass subscription limits, security rules, or App Check verification.
  • Spam, abuse, or overload the backend services or Google Generative AI (Gemini) endpoints (e.g., through automated scripts or high-frequency requests).
  • Upload or transmit any images or text that contain harmful, offensive, illegal, or malicious content.

7. DISCLAIMER OF WARRANTIES

MEDAI IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, ACCURATE, OR THAT ALARMS WILL SYSTEMATICALLY SOUND.

8. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPERS, CREATORS, OWNERS, OR DISTRIBUTORS OF MEDAI BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:

  • YOUR USE OR INABILITY TO USE THE APP.
  • ANY HEALTH COMPLICATIONS, INJURIES, OR MEDICAL CONDITIONS RESULTING FROM MISSED MEDICATIONS, ALARM FAILURES, OR INCORRECT ALARM TIMES.
  • ANY INACCURATE MEDICATION GUIDANCE OR PILL IDENTIFICATION PROVIDED BY THE AI PILL-SCAN OR CHAT FEATURES.
  • UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA.

IN NO EVENT SHALL OUR TOTAL LIABILITY FOR ALL CLAIMS EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE APP DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of Thailand, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Thailand.

10. CHANGES TO TERMS

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide notice within the App or update the "Last Updated" date at the top of these Terms. By continuing to access or use the App after those revisions become effective, you agree to be bound by the revised Terms.
